Terms and Conditions
Article 1 — General
- These terms apply to every offer, treatment and transaction between Bienahana and the client/customer to which Bienahana has declared these terms applicable, unless the parties have explicitly agreed otherwise in writing.
Article 2 — Bienahana’s commitment
- The beauty specialist will carry out the treatments to the best of her knowledge and ability and in accordance with the requirements of good workmanship.
- The client ensures that all information that may reasonably be relevant to carrying out the treatment properly is shared with the beauty specialist in good time.
- Bienahana is not liable for damage of any kind arising because the client relied on incorrect and/or incomplete information provided by the client.
- The beauty specialist will inform the client of the financial consequences of any change to the treatment.
- The beauty specialist does not carry out treatments outside her professional competence.
Article 3 — Appointments
- The client must report being unable to attend an appointment as soon as possible, and at the latest twenty-four hours before the appointment, to Bienahana.
- If the client does not meet this obligation, or not in time, Bienahana may charge the client 50% of the full fee for the agreed treatment.
- If the client arrives at the salon more than five minutes after the agreed time, the beauty specialist may shorten the treatment by the time lost and still charge the full fee for the treatment.
- If the client arrives at the salon more than thirty minutes after the agreed time, the beauty specialist may cancel the entire appointment and still charge the client 50% of the full fee for the treatment.
- Bienahana must report being unable to keep an appointment as soon as possible, and at the latest twenty-four hours before the appointment, to the client. If she does not, the client receives a 50% discount on the next treatment.
- Neither party is bound by the obligations of paragraphs 2 and 5 if prevented by force majeure. Force majeure covers what the law and case law define as such.
Article 4 — Personal data and privacy
- At the first treatment, the client provides the beauty specialist with all the information the beauty specialist indicates is necessary to carry out the treatment carefully.
- The beauty specialist records the client’s personal data on a client card, which is then kept in a client file.
- The beauty specialist is bound to secrecy regarding all confidential information the client has shared during the treatment.
- Information is considered confidential if the client said so or if it follows from the nature of the information.
- The duty of confidentiality lapses if the beauty specialist is required by a legal provision or a court ruling to disclose the confidential information to third parties.
Article 5 — Payment
- Bienahana lists the prices of the treatments on the website. The prices of products are displayed in the salon.
- The prices stated include any VAT due, where applicable.
- Offers are valid for the stated period and/or while stocks last.
- The client must pay for the treatment and any products in cash immediately after the treatment.
- If payment in cash has not been agreed, payment must be made within eight days of the invoice date to the bank account given by Bienahana. After this period the salon is in default without notice and the client owes Bienahana the statutory interest plus 2%. Payment by invoice must be agreed before the treatment.
- If a customer/client has not paid the invoice one month after the invoice date, Bienahana is entitled to engage a debt collection agency. The extra costs of this are entirely for the account of the customer/client.
Article 6 — Liability
- Bienahana is not liable for damage of any kind arising because the beauty specialist relied on incorrect and/or incomplete information provided by the client about physical conditions, use of medication, work or leisure activities.
- Bienahana is not liable for loss, theft or damage of personal belongings that the client brought to the salon.
- This article does not apply in the case of intent or gross negligence by Bienahana itself.
Article 7 — Complaints
- If the client has a complaint about the treatment or a product, the complaint must be reported to the owner of Bienahana as soon as possible, and within five days of discovery, both orally and in writing.
- Bienahana must give the complainant an adequate answer within 5 working days.
- If a complaint about the treatments is justified, Bienahana will carry out the treatment again as agreed, unless this has demonstrably become pointless for the client and the client states so in writing.
- If a complaint about the products is justified, the salon will refund the purchase price of the products in part or in full, see article 8.
- If Bienahana and the complainant cannot reach an agreement, the complainant may submit the dispute to the Disputes Committee for the beauty/pedicure sector (Geschillencommissie Schoonheidsbranche/Pedicurebranche).
Article 8 — Guarantee
- Bienahana gives the client a five-day guarantee on the treatments and products.
- This guarantee lapses if one of the following (paragraphs 3 to 7) applies.
- The client has been informed by the beauty specialist/pedicurist about the result of the treatment and how long the effect of the treatment or products lasts.
- The client has used products other than those recommended by the beauty specialist/pedicurist.
- The client has not followed the home-care advice.
- The client has not followed the advice to seek medical help within five working days.
- The client has not used the products as advised by the beauty specialist.
- After a treatment the skin may react; the client is informed of this during the treatment.
Article 9 — Damage and theft
- Bienahana has the right to claim compensation from the client if the client damages furniture, equipment or products. This also applies to damage to the business premises and/or the space where Bienahana is located.
- Bienahana always reports theft to the police.
Article 10 — Proper conduct
- The client is expected to behave in the salon according to generally accepted standards.
- If the client continues to behave improperly after repeated warnings, the beauty specialist has the right to refuse the client access to the salon without giving further reasons.

- Clients are expected to observe personal hygiene rules.
- Inappropriate sexual behaviour will be reported to the authorities and may lead to legal consequences.
Article 11 — Law
- Belgian law applies to every agreement between Bienahana and the client.
- The terms and conditions are published on Bienahana’s website (bienahana.com) and are also available in the salon.
- In case of interpretation of the content and scope of the terms and conditions, the Dutch text always prevails.
- If the client does not understand Dutch, an English translation of these terms can be requested by sending an email to our information address.
- The most recently published version always applies, or the version that applied when the agreement was concluded.
